BC law sets out who has the right to decide, in order. It belongs to the first of these who is available and willing: the executor named in the will; the spouse, including a partner of at least two years; an adult child; an adult grandchild; a parent; an adult brother or sister; an adult nephew or niece; then another adult next of kin. If the person ahead of you is unavailable or unwilling, the right passes to the next person.
